Protecting Ohioans’ Constitutional Rights Amendment

The Protecting Ohioans' Constitutional Rights Amendment adds Section 22 to Article I of the Ohio Constitution. It allows individuals to sue government actors—including state officials, subdivisions, employees, and contractors—who violate their rights under the Ohio Constitution. It eliminates immunities like qualified and sovereign immunity for such actors. Plaintiffs can seek unlimited damages, equitable relief, attorney’s fees, and other remedies. The State or political subdivision is liable for employee or contractor violations if done within their authority. Cases may be tried by jury or judge, with a six-year statute of limitations.
